Texas is intensifying its scrutiny of aid organizations along the US-Mexico border amid allegations that some are aiding migrants in illegal entry into the country. Led by Republican Texas Attorney General Ken Paxton, these efforts have sparked legal battles and accusations of harassment from targeted groups, including attempts to shut down an El Paso shelter.
The state's aggressive stance aligns with broader border security measures championed by Republican Governor Greg Abbott under Operation Lone Star, a multibillion-dollar initiative aimed at enhancing border control. In 2022, Abbott urged Paxton to investigate non-governmental organizations suspected of facilitating illegal immigration without specific evidence, citing vague "recent reports."
Paxton subsequently accused Annunciation House, a longstanding migrant shelter in El Paso, of human smuggling and other crimes, allegations vehemently denied by the organization. Similar accusations and demands for documentation have targeted other groups such as Angeles Sin Fronteras, Team Brownsville, and Catholic Charities of the Rio Grande Valley, all prominent in providing aid to migrants.

Catholic Charities, part of the Brownsville diocese, has been particularly embroiled in the legal dispute. Despite cooperating with Paxton's office by providing extensive documentation, including sworn statements, the organization faced additional demands related to its operational procedures and communications with law enforcement. In response, Catholic Charities contested these actions in court, asserting its innocence and challenging the legality of Paxton's requests.
Recent court rulings have cast doubt on the validity of Texas' approach. A judge in El Paso rebuked Paxton's office for overreaching in its efforts to obtain records from Annunciation House, describing the state's actions as unconstitutional and intolerable. While Paxton's office has the option to appeal, the legal challenges have not halted the aid groups' activities, although they have caused concern among volunteers and leaders about potential repercussions and a chilling effect on humanitarian efforts.
Marisa Limon Garza of Las Americas Immigrant Advocacy Center highlighted the broader implications of Texas' actions, viewing them as an assault on the values of binational communities and a deterrent to humanitarian aid. The ongoing legal battles underscore a contentious intersection of state enforcement and humanitarian assistance, prompting scrutiny and criticism both locally and nationally.
