NAIROBI A Kenyan High Court is set to hear an appeal on Tuesday from impeached Deputy President Rigathi Gachagua regarding his ouster, which occurred in a historic Senate vote last week. The political drama intensified when the court issued a stay on the impeachment shortly after parliament approved the appointment of his successor, Interior Minister Kithure Kindiki.

Gachagua was impeached by the Senate on Thursday after being found guilty on five of the 11 charges brought against him. These charges included accusations of inciting ethnic divisions and undermining the judiciary, actions that have drawn significant public attention and concern.
Before the Senate session, the 59-year-old Gachagua was hospitalized due to chest pains. Despite his health issues, the Senate dismissed a request from his legal team to delay the impeachment process, proceeding with the vote to remove him from office. This decision marked a significant political turning point and reflected the deepening rift between Gachagua and President William Ruto.
After his release from the hospital, Gachagua criticized President Ruto, describing him as “vicious” and alleging that there had been previous attempts on his life. He claimed that his security had been withdrawn and that his entire staff had been placed on compulsory leave, suggesting that the political fallout had escalated into personal threats.
The High Court's three-judge panel is expected to start hearing Gachagua’s appeal against his impeachment on Tuesday. The court has indicated that the petition raises "monumental constitutional issues," emphasizing the seriousness of the case.
The ruling effectively prevents Kindiki, a seasoned lawyer and influential politician, from taking over the Deputy President's role until the appeal is resolved. Ruto, who selected Gachagua as his running mate during the August 2022 elections, has yet to publicly comment on the impeachment proceedings or the subsequent developments surrounding Gachagua's appeal.
