Hong Kong finds itself in the spotlight once again as the High Court is set to deliver a decision in the protracted trial of media mogul Jimmy Lai. At 78, Lai is a prominent figure of the pro-democracy movement, having transformed Apple Daily into a significant platform that frequently challenged Beijing’s influence. Now, he faces charges under the national security law, which has dramatically altered Hong Kong’s legal and political framework since its introduction in 2020.
Lai’s path to this pivotal moment began when he founded Apple Daily in 1995. The paper quickly garnered attention for its fearless journalism and robust advocacy for democracy. However, the introduction of the national security law in June 2020 changed everything. This legislation penalizes actions deemed as collusion with foreign entities or subversion with harsh penalties, including life sentences. Shortly after its enforcement, Lai was arrested during a police raid on his office. Although he initially secured bail, a series of new charges followed, complicating his legal journey.
In addition to facing prison time for participating in pro-democracy protests in 2019, Lai’s company, Next Digital, faced financial strain due to asset freezes and mounting state pressures. Apple Daily published its final edition in June 2021, producing one million copies as crowds flocked to purchase this newspaper, which had come to symbolize the liberties enjoyed in Hong Kong.
Lai’s situation further deteriorated over the years. In 2022, the Justice Secretary mandated that his national security trial proceed without a jury, claiming that foreign involvement might jeopardize the trial's integrity. Delays ensued as the government sought Beijing's ruling on the participation of foreign lawyers. Subsequently, only lawyers authorized in Hong Kong were permitted, thereby blocking British lawyer Tim Owen from defending Lai.
Despite efforts to contest this ruling, Lai could not appoint his preferred legal representation. The trial eventually commenced in December 2023, with Lai testifying for 52 days and asserting that he never sought to sway foreign policies of nations like the United States regarding China or Hong Kong. Stretching across 156 days, this trial stands as one of the longest and most politically charged cases in Hong Kong’s recent history.
International attention regarding the case remains significant, with even former U.S. President Donald Trump mentioning Lai during an encounter with China’s President Xi Jinping in South Korea in 2025. As the trial neared its conclusion, Lai experienced health complications such as heart palpitations, which delayed proceedings as he received medical attention.
As Hong Kong anticipates the verdict, Lai’s narrative transcends mere legal matters. For many globally, he embodies the struggle for freedom of expression and democratic principles, while authorities perceive him as a figure of foreign meddling and uncertainty. His extensive legal battle has become emblematic of the deepening divisions shaping Hong Kong’s trajectory.
The verdict expected on Monday is poised to not only determine Lai’s future but also offer insight into Hong Kong’s evolving identity under new political landscapes and the prospects for dissent, free expression, and independent media. The world looks on closely as this pivotal moment approaches.
