BRUSSELS, 22 February 2026 – The European Commission has requested full clarity from the United States on the steps it plans to take following the recent Supreme Court ruling on the International Emergency Economic Powers Act (IEEPA).
The Commission stated that the current situation is not conducive to maintaining “fair, balanced, and mutually beneficial” transatlantic trade and investment, as agreed in the EU-US Joint Statement of August 2025.
The EU emphasized that its companies and exporters must receive fair treatment, legal certainty, and predictability, and that tariffs should not rise beyond previously agreed ceilings. Unpredictable tariffs, it said, disrupt global markets and international supply chains.
The European Commission is in continuous contact with the US administration. EU Trade Commissioner Maroš Šefčovič spoke with US Trade Representative Jamieson Greer and Commerce Secretary Howard Lutnick on 21 February to discuss lowering tariffs and preserving a stable transatlantic trading environment.
The Commission reaffirmed its commitment to protecting EU interests while ensuring a rules-based and predictable global trade system.
