Sheikh Mansour bin Zayed Al Nahyan has issued Resolution No. 3 of 2026 to establish specialised Family Business Dispute Resolution Committees in Abu Dhabi. The initiative aims to strengthen the legal and judicial framework supporting family businesses and ensure their long-term stability and economic contribution.
Under the resolution, the committee will handle disputes related to family businesses headquartered in Abu Dhabi. These include disagreements concerning company ownership, management, and memorandums of association. The committee will also address conflicts between partners, family members, the business itself, and even third parties.
Additionally, the committee has been authorised to review grievances against decisions made by the Family Council for Dispute Settlement, as outlined in Federal Decree-Law No. 37 of 2022 on Family Businesses. Such grievances must be submitted within 30 days of the decision being issued or communicated; otherwise, they will be considered invalid.
The resolution grants the committee broad powers to ensure business continuity during disputes. It can take urgent and preventive measures to protect companies from operational disruptions, reputational damage, or financial instability. The committee is also empowered to consult experts from the Abu Dhabi Judicial Department (ADJD), external specialists, or relevant government entities based on the nature of each case.
In terms of dispute resolution procedures, cases may first be referred to the Dispute Settlement Center if no Family Council exists or if parties agree to bypass it. If these mechanisms fail to resolve the issue, the committee will intervene and issue expedited decisions. These rulings will carry the same legal authority as judgments from a Court of First Instance and can be appealed under the Civil Procedures Law.
The resolution also strongly emphasises confidentiality. Strict legal and disciplinary actions will be taken against anyone who discloses sensitive information related to disputes, including details about the parties involved or the businesses concerned.
The committee will be chaired by a judge and supported by two experts specialising in legal, financial, or family business management fields, along with a secretary. Members will be appointed by the Undersecretary of the Judicial Department, while the chairman will be nominated by the Judicial Council.
This move reflects Abu Dhabi’s commitment to fostering a secure and transparent business environment, particularly for family-owned enterprises that play a key role in the region’s economy.
