Sharjah Ruler Issues Emiri Decree to Establish Public Prosecution Department

His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, the Supreme Council Member and Ruler of Sharjah, has issued a significant Emiri Decree establishing a new judicial authority known as the “Public Prosecution” in the Emirate. This entity will hold the responsibility of investigating and bringing charges before the competent courts within the Emirate, along with any additional powers assigned by the Judicial Council. The Public Prosecution will have its own legal personality and capacity to fulfill its objectives while maintaining financial and administrative independence under the Judicial Council.

The structure of the Public Prosecution will include a Public Prosecutor, supported by public attorneys, heads of the Public Prosecution, and their deputies and assistants. Their appointments will be made through Emiri decrees or decisions from the Judicial Council. Furthermore, a specific law will be enacted to regulate the authority and functions of the Public Prosecution, in line with the established legislative procedures in the Emirate.

The Decree also outlines transitional provisions to ensure a seamless transition from the current judicial framework to the new authority. Public attorneys, heads of the Public Prosecution, their agents, assistants, and the administrative and technical staff affiliated with the federal Ministry of Justice will be transferred to the Public Prosecution, following the stipulations of Cabinet Resolution No. (46) of 2019. Additionally, all assets, contracts, rights, obligations, accounts, and technical systems currently managed by the Ministry of Justice will also be transferred to the new authority. A joint committee will be established between the Government of the Emirate of Sharjah and the Federal Supreme Judicial Council to oversee the transfer process, submitting reports and recommendations to the relevant higher authorities. 

During the transitional period, the existing judicial operations in Sharjah will continue according to the regulations and procedures followed in the Ministry of Justice, until the new law regulating the Public Prosecution is enacted and the transition is fully completed. This landmark decision signifies a substantial advancement in Sharjah’s judicial landscape, underscoring the Emirate's commitment to enhancing its legal framework and ensuring effective prosecution capabilities.
