China has tightened its laws on disaster management and media control, imposing stricter regulations aimed at enhancing emergency response capabilities and managing information dissemination during crises. Under these legal revisions, effective from November 1, foreigners residing in China must adhere to local laws and comply with government decisions and directives.
The revised Emergency Response Law significantly increases penalties for inadequate disaster preparation or response, raising the maximum fine five-fold to 1 million yuan ($140,000). It also imposes tighter government oversight over media coverage of emergencies, aiming to ensure that news reporting is timely, accurate, objective, and fair. Government agencies are mandated to guide and supervise news media, supporting them in reporting while monitoring public opinion.
The amendments, passed by China's National People's Congress Standing Committee, add more than 30 provisions to the 2007 law. They prohibit government agencies from delaying, falsifying, or concealing information related to emergencies, addressing past instances where tardy responses led to public outcry. For instance, delays in reporting a fatal hospital fire in Beijing and inadequate flood warnings in Zhuozhou sparked widespread criticism.

According to experts, including Katja Drinhausen from the Mercator Institute for China Studies and Jemimah Steinfeld from Index on Censorship, these revisions tighten state control over information flows. They emphasize a more prescriptive approach to journalism during emergencies, potentially restricting media freedom further.
Foreign journalists operating in China have faced challenges in reporting on emergencies, encountering resistance and obstruction at times. Instances of foreign journalists being targeted by crowds during coverage of disasters, as reported during the Zhengzhou floods by German media DW, highlight tensions around media coverage in China.
Overall, the revised laws underscore China's efforts to strengthen crisis management and regulate media reporting, posing implications for foreigners, media outlets, and international businesses operating in the country. Understanding and adhering to these regulations becomes crucial amidst China's evolving legal landscape and political expectations during emergencies.
