A judge in the U.S. has dismissed a case against singer Dua Lipa about her song Levitating. Two songwriters, L. Russell Brown and Sandy Linzer, had claimed that she copied parts of their old songs Wiggle and Giggle All Night (1979) and Don Diablo (1980). But on March 27, 2025, Judge Katherine Polk Failla said that the songs were not similar enough under the law, so the case was closed.

This was not the first time Dua Lipa was taken to court for Levitating. In March 2022, a band from Florida called Artikal Sound System also said that Lipa copied their song Live Your Life (2017). But in June 2023, a judge dismissed that case, saying there was not enough proof.
Brown and Linzer, in their case, said that the beginning tune of Levitating was the same as their songs. They also said that Dua Lipa wanted her song to sound like old music from the past. But the judge did not agree. She said that the part they were arguing about was just a simple music scale that many songs use. She also pointed out that Levitating had an extra note that made it different.
The judge also talked about a similar case with singer Ed Sheeran. He had been accused of copying Marvin Gaye’s song Let’s Get It On. But he won because the court said that common music chords and rhythms cannot be owned by anyone. The judge used the same rule in Dua Lipa’s case and said that music scales and chords are not protected by copyright law.
The ruling also said that even if some people think the songs sound alike, that does not mean there was copying. The judge explained that the part of the songs that sound similar is not something that can be owned by one person or group.
Even though Dua Lipa won this case, she still has another case against her for Levitating. In 2023, music producer Bosko Kante sued her, saying that she used a special voice effect he created without permission. That case has not been decided yet.
For now, this ruling is good news for Dua Lipa. The judge’s decision shows that basic music sounds, like scales and chords, belong to everyone, and artists can use them in new songs.
