Canada’s New Visa Rules Could Be a Nightmare for Indian Students, Workers

Ottawa, Canada: Canada has introduced new visa rules starting from February, which could create difficulties for many foreign students, workers, and migrants, including those from India. These rules give Canadian border officers more power to change or cancel visas at any time if they feel it is necessary.

Under the new Immigration and Refugee Protection Regulations, border officials now have the authority to reject or cancel temporary resident documents like electronic travel authorizations (eTAs) and temporary resident visas (TRVs). This means that student visas and work permits can be denied or taken away even after someone has already entered Canada.

What Has Changed?

If a border officer believes that a student, worker, or migrant may not leave Canada after their visa expires, they can refuse entry or cancel the visa.
The decision to allow or deny a visa is completely up to the border officer.
If a visa or permit is cancelled while the person is already in Canada, they will be given a notice to leave the country within a certain time.
People who are stopped at the airport or any entry point will be sent back to their home country immediately.

Who Will Be Affected?

This change could impact thousands of foreign nationals, especially Indian students and workers, as they form the largest group of migrants in Canada. According to government data, over 4.2 lakh Indian students are currently studying in Canada. Additionally, a large number of Indian workers and migrants could also face uncertainty due to these new rules.

Canada is one of the most popular destinations for Indian students, professionals, and legal migrants. Even for tourism, Canada sees a huge number of visitors from India. In the first six months of 2024 alone, over 3.6 lakh Indians were issued travel visas to visit Canada.

What Happens If a Visa Is Cancelled?

If a student, worker, or migrant's visa is rejected or cancelled:

They will not be allowed to enter Canada and will be sent back immediately.
If they are already in Canada, they will get a notice to leave the country within a specific time.
There is no clarity on whether they will get back the money they have spent on education, rent, or other expenses.
Past Visa Policy Changes
Just three months ago, in November 2024, Canada shut down the Student Direct Stream (SDS) visa program. This program allowed Indian students to secure their education in Canada by paying a fixed amount of money upfront. Its closure already created difficulties for many students, and now these new rules have added to their worries.

How Will People Be Informed?
Those who are affected will receive a notification from Immigration, Refugees, and Citizenship Canada (IRCC) via email and their IRCC account. However, there is no clear information on what will happen to the money they have already invested in their education, rent, or other expenses if their visa gets cancelled.

With these changes, many Indian students, workers, and migrants are now facing uncertainty about their future in Canada. The new rules have raised concerns about fairness, as border officials have been given complete authority to make visa decisions. Many people are now waiting to see how these policies will be enforced in the coming months.
