Sharjah approves draft law to regulate real estate leasing.

The Sharjah Consultative Council (SCC) has recently approved a draft law for the year 2024 concerning real estate leasing in the Emirate of Sharjah. This significant development follows a series of amendments made to the draft law during the sixth meeting of the first regular session of the eleventh legislative term. In his address, Counselor Dr. Mansour Mohammed bin Nassar, Head of the Legal Department of the Government of Sharjah, commended the SCC for its role in finalizing the legislative process of draft laws. He emphasized the importance of the approved draft law in establishing a framework that contributes to the advancement of Sharjah's interests and ensures the regulation of landlord-tenant relationships in accordance with existing laws in the city. Sharjah's appeal as an attractive environment for investors and residents underscores the necessity of robust legislation to govern real estate transactions, including leasing, purchasing, and other property rights, all of which will be addressed by the new draft law. Given that the previous law dates back to 2007, an update is imperative to accommodate developments and address the evolving needs of stakeholders.

Khaled Falah Al Suwaidi, Director of Customer Service at Sharjah Municipality, emphasized the significance of the draft law in regulating real estate leasing and its potential to enhance tourism, investment, and residential attractiveness in the emirate. He highlighted that the draft law incorporates provisions aimed at addressing societal needs and aligning with the evolving demands of Sharjah's real estate sector. Hamad Abdel Wahab Al Qawadi, Rapporteur of the Council's Legislative and Legal Affairs Committee, presented the draft law for discussion, outlining its objectives, definitions, competencies, and legal provisions.

Chaired by Dr. Abdullah Belhaif Al Nuaimi, Chairman of SCC, the meeting deliberated on the draft law and reviewed the report presented by the Council's Legislative and Legal Affairs Committee. Counselor Dr. Mansour Mohammed bin Nassar and Issa bin Hanzal, Director of the Legal Department of the Government of Sharjah, along with representatives from Sharjah Municipality, provided insights into the draft law's interpretation and implementation. Members of the Council offered various perspectives on the draft law's articles, prompting discussions on its practical implications and legal intricacies.

Ultimately, the Council endorsed the draft law, marking it as the second legislative item to be discussed during its eleventh term. The approval signifies a milestone in Sharjah's ongoing efforts to enhance its legal framework and ensure the effective regulation of real estate leasing practices. As the session concluded, Secretary-General Ahmed Saeed Al-Jarwan announced the Council's intention to address recommendations concerning the policy of the Sharjah Tourism and Commerce Development Authority in its upcoming meeting.
