Representatives of the Enforcement Directorate (ED) made a strong assertion during the hearing at the Rouse Avenue Court regarding Delhi Chief Minister Arvind Kejriwal's bail plea. They highlighted that the Supreme Court's order specifically prohibited Kejriwal from submitting an interim bail extension plea, permitting only a regular bail plea.
The ASG Raju emphasized that as per the Supreme Court's directive, bail could only be sought if the individual is in custody. Therefore, an interim bail application becomes invalid as Kejriwal is currently not in custody. Moreover, the ED accused Kejriwal of withholding crucial information regarding the nature of the medical examination he was required to undergo. They also pointed out that Kejriwal had previously filed a similar petition in the Supreme Court.

Furthermore, the ED raised objections, asserting that a trial court lacks inherent authority to grant release without adhering to the provisions of Section 45 of the Prevention of Money Laundering Act. Such authority is reserved for the High Court and Supreme Court, they argued.
It's notable that the apex court had granted Kejriwal a 21-day interim bail on May 10 to facilitate his participation in campaigning during the Lok Sabha elections. However, this interim bail period concludes today, leading to Kejriwal's imminent return to Tihar jail tomorrow.
The court, in light of these arguments, reserved the order on Kejriwal's bail plea until June 5, which coincides with the day following the Lok Sabha election results. Kejriwal's return to Tihar jail is anticipated as his interim bail period expires today.
